Terms of Service
These terms are an agreement between you and Jeremiah Welch, doing business as Kubrick ("Kubrick", "we", "us"), for your use of the Kubrick website, app and related services at kubrick.studio (the "Service"). By creating an account or using the Service you agree to them. If you use Kubrick for a company, you agree on its behalf. Our Privacy Policy explains how we handle your information.
Your account
You must be at least 13 years old (or older where local law requires) to use Kubrick. Keep your sign-in secure; you are responsible for what happens in your account. Tell us at hello@kubrick.studio if you think someone else has accessed it.
Your content
You own what you make and upload. You give us permission to host, store, copy, process, render and display your content as needed to run the Service for you, including sending it to the service providers and AI providers described in the Privacy Policy, and showing shared projects to the people you share them with. Unless you turn off "Help improve Kubrick" in your account, you also give us permission to use your content and how you use Kubrick to improve the Service, including to train Kubrick's own AI models, as described in the Privacy Policy. We will not sell your content or license it to others. These permissions end when you delete the content or your account, except for copies we must keep by law or that remain briefly in backups, and except that models already trained are not retrained to remove it.
You are responsible for your content and promise that you have the rights to everything you upload, including music, footage, images, fonts and logos, and that your use of Kubrick's output does not infringe anyone else's rights.
What Kubrick provides
Templates, rigs, effects, stock media and other material we provide in Kubrick ("Kubrick Materials") remain ours or our licensors'. You may use them in videos you make with Kubrick, for personal or commercial purposes, including the videos you export. You may not resell or redistribute Kubrick Materials on their own, or use them to build a competing product. Stock media may come with its own licence terms, which we show where they apply.
AI features
Kubrick's AI features generate projects, layers, text, voiceovers and other output from your requests. Output may be inaccurate, may resemble other people's work, or may not be what you asked for. Review it before you publish it. Between you and us, you own the output you generate, to the extent the law allows. Do not use AI features to create content that breaks these terms or the law.
Acceptable use
Do not use Kubrick to:
- break the law or infringe anyone's intellectual property, privacy or other rights;
- make content that is sexual content involving minors, harassment, hate, threats, or that encourages violence;
- make deceptive content meant to impersonate real people or organisations, or to mislead people about who made it;
- send spam, malware, or attempt to access accounts or systems you are not allowed to;
- overload, reverse engineer, scrape or interfere with the Service, or get around usage limits.
We may remove content or suspend accounts that break these rules.
Plans, trials and payment
Some features require a paid subscription. Prices and what each plan includes are shown in the app before you subscribe. Paid plans are billed in advance through Stripe and renew automatically each period until you cancel. If a plan starts with a free trial, you will be charged when the trial ends unless you cancel before then. You can cancel any time in the app; you keep access until the end of the period you have paid for. Payments are non-refundable except where required by law or where we say otherwise. We may change prices with at least 30 days' notice; changes apply from your next billing period.
Changes and availability
Kubrick is being actively built. We may add, change or remove features. We will try to give notice of changes that significantly reduce what a paid plan includes. We do not promise the Service will always be available or error-free; keep your own copies of anything important, such as exported videos.
Ending your use
You can stop using Kubrick and delete your account at any time. We may suspend or end your access if you break these terms, if required by law, or if we stop offering the Service; where reasonable we will give you notice and a chance to export your work.
Disclaimers
The Service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $100. Some places do not allow these limits, so they may not apply to you.
Indemnity
If someone makes a claim against us because of your content or your breach of these terms, you agree to cover our reasonable costs of dealing with it, to the extent allowed by law.
Changes to these terms
We may update these terms. We will change the date at the top, and for significant changes we will tell you by email or in the app before they take effect. If you keep using Kubrick after that, the new terms apply.
General
These terms are the whole agreement between you and us about the Service. If part of them cannot be enforced, the rest still applies. Not enforcing a right is not a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a sale or reorganisation of the business, including to a company formed to run Kubrick.
